1. Agreement to Terms
By accessing or using HeyMag's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our Service.
These Terms apply to all visitors, users, and others who access or use our Service, including the WhatsApp Business API integration and automation services.

HeyMag provides:
- WhatsApp Business API integration services
- Telegram bot automation services
- AI-powered customer service automation
- Appointment booking and management systems
- Message routing and workflow automation
- Analytics and reporting tools
3. Account Registration
3.1 Eligibility
- You must be at least 18 years old
- You must have the legal authority to enter into these Terms
- You must provide accurate and complete registration information
- You must have a legitimate business purpose for using our Service
3.2 Account Security
- You are responsible for maintaining account security
- You must notify us immediately of any unauthorized access
- You are responsible for all activities under your account
- You must not share your account credentials
4. WhatsApp Business API Terms
4.1 Compliance Requirements
- You must comply with Meta's WhatsApp Business Terms of Service
- You must obtain proper consent before messaging customers
- You must respect the 24-hour conversation window
- You must not send spam or unsolicited messages
- You must use approved message templates for business-initiated conversations
4.2 Your Responsibilities
- Obtain and maintain your own WhatsApp Business verification
- Provide valid business documentation to Meta
- Maintain accurate business information
- Handle customer data in compliance with privacy laws
- Pay Meta's messaging fees directly
5. Acceptable Use Policy
You agree NOT to:
- Violate any laws or regulations
- Send spam, phishing, or fraudulent messages
- Harass, abuse, or harm others
- Impersonate others or provide false information
- Transmit viruses or malicious code
- Attempt to gain unauthorized access to our systems
- Use the Service for illegal or unauthorized purposes
- Resell or redistribute our Service without permission
- Reverse engineer or attempt to extract source code
- Use automated systems or bots to access the Service
6. Payment Terms
6.1 Subscription Plans
- Starter: $49/month - 10,000 messages
- Professional: $119/month - 50,000 messages
- Enterprise: Custom pricing - 500,000+ messages
6.2 Billing
- Subscriptions are billed monthly or annually in advance
- Payment is processed through Stripe
- Prices are in USD unless otherwise specified
- You authorize automatic recurring payments
6.3 Additional Costs
- Meta's WhatsApp messaging fees are separate and billed directly by Meta
- Overage charges apply if you exceed your plan's message limit
- Custom integrations may incur additional fees
7. Cancellation and Refunds
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- No refunds for partial months or unused messages
- Annual plans: Pro-rated refund within 30 days of purchase
8. Intellectual Property
8.1 Our Property
The Service and its original content, features, and functionality are owned by HeyMag and are protected by international copyright, trademark, and other intellectual property laws.
8.2 Your Content
- You retain ownership of content you upload
- You grant us a license to use your content to provide the Service
- You are responsible for ensuring you have rights to the content
9. Data Processing
- We process data according to our Privacy Policy
- You must have lawful basis to share customer data with us
- We act as a data processor; you are the data controller
- You must comply with applicable data protection laws (GDPR, CCPA, etc.)
10. Service Level Agreement
- Uptime Target: 99.9% for Enterprise plans
- Support Response:
- Starter: 48 hours
- Professional: 24 hours
- Enterprise: 8 hours
- Scheduled maintenance excluded from uptime calculations
11. Disclaimers and Limitations
11.1 Service Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
11.2 Limitation of Liability
To the maximum extent permitted by law, HeyMag shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
11.3 Maximum Liability
Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold HeyMag harmless from any claims, losses, damages, liabilities, and expenses arising from your use of the Service, violation of these Terms, or violation of any rights of another party.
13. Termination
- We may terminate or suspend your account for violations of these Terms
- We may terminate with 30 days notice for any reason
- Upon termination, your right to use the Service ceases immediately
- You may export your data within 30 days of termination
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Singapore.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
17. Entire Agreement
These Terms constitute the entire agreement between you and HeyMag regarding the use of the Service, superseding any prior agreements.
